Government lacks legal capacity to dissolve National Cathedral Board of Trustees

Charles J Owusu, a legal representative of the National Cathedral Board of Trustees, has stated that the government lacks the legal capacity to dissolve the Board.

He explained that the National Cathedral was legally registered as a company limited by guarantee and that government cannot decide to dissolve it at will without recourse to the court.

The registration of the National Cathedral as a company limited by guarantee, did not make it an entity and as such, it is governed under the Companies Act, not by public service regulations or Cabinet decisions.

His explanations come on the heels of growing concern by many citizens and calls on the government to have the board of trustees dissolved with immediate effect.

Giving his legal understanding of the matter, graphic.com.gh reported him as saying’ “This structure means the board cannot just be dissolved by the government. That power lies only with the courts,”.

Addressing the press in Accra on Thursday on July 24, 2025, he denied allegations of corruption levelled against the members of the board of trustees saying they are being unfairly targeted by politicians.

According to him, the need to come out to set the records straight has become imperative in view of the fact that all the trustees’ members are mainly leaders in Ghana’s main Christian denominations.

He explained that his intervention to clear the names of the members of the Board of Trustees of any wrongdoing, as has been speculated, has become necessary in view of the clerical roles the members play in society.

He appealed to President John Mahama to show interest in the project and support its completion or “If you cannot help, do not block others from helping. Let us build our cathedral”.

Lawyer Owusu expressed concern over what he termed as misinformation and criticisms which did not offer a fair hearing to members of the board.

“If there is wrongdoing, let it be proven in court. But if not, stop dragging men of God into public ridicule,” he said.
