We’ve filed an appeal against contempt conviction of Akwatia MP – Minority

Minority in Parliament has initiated an appeal against a ruling by the High Court against Akwatia MP who is a member of the Minority Caucus.

The High Court in Koforidua on February 19 issued a bench warrant for the arrest of Akwatia Member of Parliament, Ernest Yaw Kumi, after convicting him of contempt of court.

The ruling stems from Yaw Kumi’s decision to continue holding himself out as an MP despite an interim injunction barring him from being sworn into office.

The court had earlier directed him to refrain from assuming the parliamentary role until a legal dispute was resolved, but he defied the order and took the oath of office in Parliament.

But the Minority in Parliament at a press briefing on Thursday, February 20 stated that they have filed an appeal against the contempt conviction at the Court of Appeal.

Deputy Minority Chief Whip, Jerry Ahmed Shaib told journalists at a press briefing in Parliament that an application for a stay of execution of the bench warrant has also been filed at the High Court in Koforidua.

He added that respondents and parties involved in the matter including Justice Senyo Amedahe, the Judge who gave the ruling have been duly served.

“At this stage, let me state further that legal steps have been taken, a notice of appeal have been filed against the ruling of the High Court at the Court of Appeal, an application for stay of execution pending appeal has also been filed at the High Court number 3 Koforidua.

“Moreover, all the parties to the certiorari and prohibition application including the judge, His Lordship Justice Senyo Amedahe who is the respondent to this application before the Supreme Court have been duly served,” he noted.

The Minority Caucus emphasised that further legal steps will be taken on the matter.
