Bailiffs serve NPP’s Akua Afriyie substituted service via WhatsApp and office

On February 6, 2025, Justice H Kwofie ordered lawyers of the NDC Parliamentary candidates of Ablekuma North, Tema Central, Okaikoi Central and Techiman South to serve the NPP candidates using substituted service.

They included:

a) posting copies of the Certiorari Application, the Supporting Affidavit, the supplementary affidavit in support of the certiorari application on the Notice Board of the Supreme Court.

b) posting copies of the Certiorari application, Supporting Affidavit and the Supplementary Affidavit in support of the certiorari application on the 4th Interested Party at House No. 9, Glover CLGT 085-5138, Tema Community 6.

c) posting copies of the Certiorari Application, supporting Affidavit and the supplementary affidavit in support of the certiorari application at the office of the 3rd Interested Party, GA-500-6603, Odorkor, Accra

d) serving copies of the Certiorari Application, Supporting Affidavit and the Supplementary Affidavit in support of the certiorari application specifically in relation to the 2nd, 4th, and 5th Interested Parties, on the Legal Department of the office of Parliament.

e) serving copies of the Certiorari Application, Supporting Affidavit and the Supplementary Affidavit in support of the certiorari application via the WhatsApp Contacts of the 3rd to 5th Interested Parties.

On Thursday, February 20, the Supreme Court bailiffs served NPP’s Ablekuma North candidate, Akua Afriyie, at her office and via WhatsApp.

Background

The Ablekuma North parliamentary election is one of the few remaining seats yet to be declared by the Electoral Commission of Ghana (EC), adding to the tension surrounding the outcome. 

Both candidates are vying for victory in what has been a fiercely contested constituency.

While the exact details of the legal action remain undisclosed, the case is believed to be linked to electoral irregularities or disputes over the results. With the court now permitting substituted service, the legal process will proceed, and Nana Akua Owusu Afriyie is expected to respond within the stipulated timeframe.

If the NPP candidate fails to respond, the court may proceed with the case in her absence, potentially impacting the final declaration of the seat. 

The legal battle further complicates the already uncertain outcome of the Ablekuma North parliamentary race, which remains unresolved nearly three months after the general elections.
