The Accra High Court’s Industrial and Labour Division has approved a request by the National Labour Commission (NLC) to serve an interlocutory injunction on the Ghana Registered Nurses and Midwives Association (GRNMA) through substituted means.
The court’s decision, delivered by Justice Priscilla Dikro Ofori on Tuesday, June 10, follows the NLC’s complaint that it had been unable to serve the GRNMA directly with an injunction secured on June 5.
In response, the court granted permission for the injunction notice to be delivered through alternative channels. These include posting the order on the court’s notice board and at the main entrance of the GRNMA’s head office. In addition, digital copies of the injunction are to be sent via WhatsApp to the association’s President, Perpetual Ofori Ampofo, and General Secretary, David Tenkorang-Twum.
Per the ruling, the substituted service will be considered officially completed 14 days after the postings, effectively giving the GRNMA formal notice of the court’s order.
This legal development comes as tensions escalate between the GRNMA and the government over unresolved negotiations surrounding conditions of service. The ongoing strike by nurses and midwives has already disrupted healthcare services nationwide, and the injunction represents a significant escalation in the standoff.
While the NLC seeks to compel the association to halt its industrial action, the GRNMA maintains that the government has failed to address their long-standing concerns, setting the stage for a deepening legal and labour dispute.
