Court of Appeal bars Peter Amewu from claiming Hohoe MP status pending appeal

The Court of Appeal sitting in Koforidua has granted an interlocutory injunction against John Peter Amewu, restraining him from presenting himself as the former Member of Parliament (MP) for Hohoe Constituency in the 8th Parliament of the Fourth Republic.

The injunction was filed by Professor Margaret Kweku and others from the SALL (Santrokofi, Akpafu, Likpe, and Lolobi) traditional areas, challenging the legitimacy of Mr. Amewu’s parliamentary status following the disputed 2020 elections.

In its ruling, the Court further barred the Speaker of Parliament from processing or paying any entitlements to Mr. Amewu as a former MP until the final determination of the appeal case.

The case stems from a July 29, 2024, ruling by the Ho High Court, presided over by Justice Owoahene Acheampong, which dismissed the petition challenging Mr. Amewu’s election on grounds of lack of jurisdiction.

A Notice of Appeal was subsequently filed on July 31, 2024, followed by the application for an interlocutory injunction on December 23, 2024.

Representing the petitioners, legal practitioner Tsatsu Tsikata argued that allowing Mr. Amewu to continue receiving benefits as a former MP would prejudice the outcome of the ongoing appeal and undermine justice.

In response, counsel for Mr. Amewu defended his client, arguing that he had committed no wrongdoing and that if any misdirection had occurred, it was the Electoral Commission that should be held accountable.

The three-member panel of the Court of Appeal, chaired by Justice Bright Mensah, with Justices Noble Nkrumah and Hasata Amaleboba, ruled that the application had merit and granted the injunction.

The case is now pending further proceedings at the appellate level.
