Minority Leader Alexander Afenyo-Markin has strongly condemned the reported raid on the residence of former Finance Minister Ken Ofori-Atta, describing the action as unconstitutional and a violation of fundamental rights.
Addressing Parliament on Wednesday, February 12, Afenyo-Markin criticised the alleged involvement of state security operatives, arguing that such acts threaten Ghana’s democracy.
“If you invade someone’s home without lawful authority, you are violating Article 18 of the Constitution, which protects that right,” he stated. “There was no legal basis for this raid, and it is entirely unconstitutional.”
Afenyo-Markin emphasised that Mr. Ofori-Atta had already informed the state of his travel plans and provided medical records from a recognised health facility. He questioned why authorities resorted to such drastic measures instead of following due legal processes.
“If there is any concern, we must follow the due process of law. A home raid is not an acceptable means of ensuring national security,” he argues.
He further warned that if such actions go unchecked, they could set a dangerous precedent.
“Today it is Ken Ofori-Atta, and tomorrow it could be another public servant. We must not allow this to continue,” he cautioned.
The Minority Leader acknowledged Ofori-Atta’s role in Ghana’s economic management, particularly in ensuring the successful rollout of the Free Senior High School (Free SHS) policy.
“Indeed, the successful implementation of Free SHS was led by Ken Ofori-Atta as finance minister; he made sure he rolled out all important policies of government,” Afenyo-Markin noted. “If there is any issue, let us address it through proper legal channels rather than through acts that undermine our constitutional rights.”
Afenyo-Markin urged his colleagues in Parliament—both in the minority and majority—to stand together in upholding the rule of law and preventing state institutions from overstepping their constitutional limits.
“I will conclude by urging my colleagues to support this call in bringing sanity to the country so that nobody will take the advantage to unleash any violence on anybody,” he stated.
His remarks come in response to a press briefing held earlier on Wednesday, where Special Prosecutor Kissi Agyebeng declared Ken Ofori-Atta a fugitive over alleged corruption.
The former Finance Minister is accused of involvement in multiple financial dealings, including the controversial National Cathedral project, Strategic Mobilisation Ghana Ltd. (SML) contract scandal and others.
Despite these allegations, Afenyo-Markin insists that investigations must be handled transparently and lawfully, without resorting to unconstitutional measures such as home raids.
